Acceptance of Terms
By scheduling, authorizing, or using services provided by Caron Heating & Cooling, Inc. (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. These Terms apply to all service, maintenance, and installation work performed by the Company.

Scope of Services
We provide heating, ventilation, air conditioning (HVAC), and related services including installation, repair, replacement, and maintenance. The scope, equipment, and pricing for each project will be defined in your written estimate, proposal, or invoice.

Estimates, Proposals & Change Orders
- All estimates are based on visible and known conditions at the time of evaluation.
- Hidden conditions (e.g., electrical deficiencies, structural issues, code violations, asbestos, mold, or inaccessible areas) may require additional work and cost.
- Any additional work will be documented and approved via a written change order before proceeding.
- Estimates are valid for the period stated on the proposal (typically 14 days).

Deposits & Payment Terms
- Service Work: Payment is due in full upon completion.
- Installation Projects: A 10% deposit is required to secure scheduling and order equipment.
- Progress payments may be required depending on project size.
- Final payment is due upon completion of the installation.
- We accept cash, check, and approved electronic payment methods.
- Late balances may incur finance charges up to 1.5% per month (18% annually), or the maximum allowed under Massachusetts law.

Scheduling, Access & Cancellations
- Customers must provide safe, clear access to equipment and work areas.
- A minimum of 24 hours’ notice is required for cancellations or rescheduling.
- Missed appointments or no-shows may be subject to a service fee.
- We reserve the right to reschedule due to weather, supply chain delays, or emergency service demands.

Permits, Licensing & Code Compliance
- Where required, permits will be obtained in accordance with Massachusetts/New Hampshire law and local municipal requirements.
- All work is performed in compliance with applicable codes, including the Massachusetts State Building Code (780 CMR) and relevant mechanical, gas, and electrical codes.
- Caron Heating & Cooling, Inc. maintains all required state and local licenses.

Mechanics Lien Rights (Massachusetts)
Under Massachusetts General Laws Chapter 254, contractors and suppliers who provide labor or materials may have the right to file a mechanics lien against the property if payment is not made. By accepting service, you acknowledge these rights.

Warranties
- Manufacturer Warranty: All equipment is subject to the manufacturer’s warranty terms and registration requirements.
- Labor Warranty: Any labor warranty offered by Caron Heating & Cooling will be stated in writing on your proposal or invoice.
- Warranty coverage may be void if:
- Equipment is not properly maintained
- Work is altered or serviced by unauthorized parties
- System is operated outside manufacturer specifications

Maintenance Requirement
High-efficiency systems (including ductless and heat pump systems) require regular maintenance. Failure to maintain equipment may:
- Reduce efficiency and lifespan
- Void manufacturer or labor warranties
We strongly recommend annual service agreements.

Limitation of Liability
- We are not responsible for pre-existing conditions, concealed defects, or issues outside our scope of work.
- We are not liable for indirect or consequential damages, including loss of use, property damage due to system failure, or delays beyond our control.
- Liability is limited to the total amount paid for the specific service provided.

Emergency & After-Hours Service
After-hours, weekend, and holiday service calls are billed at elevated rates (with the exception of those customers that hold a maintenance agreement). Customers will be informed of applicable rates prior to dispatch whenever possible.

Cancellations & Refunds
- Deposits may be non-refundable once equipment has been ordered or work has commenced.
- Special-order or custom equipment is non-refundable.
- Approved refunds will be issued in accordance with Massachusetts consumer protection laws.

Customer Responsibilities
- Provide accurate information regarding system issues and property conditions.
- Ensure pets are secured and work areas are safe.
- Notify us of any known hazards (electrical, asbestos, structural, etc.).

Use of Photos & Media
We may document installations and service work for quality control, training, and marketing. No personally identifiable information or identifiable property details will be shared without consent.

Privacy
Customer information is handled in accordance with our Privacy Policy. We do not sell customer data. Information is used solely to provide and improve our services.

Messaging
You agree to receive informational messages (appointment reminders, account notifications, etc.) from Caron Heating and Cooling. Message frequency varies. Message and data rates may apply. For help, reply HELP or email us. You can opt out at any time by replying STOP.

Right to Refuse or Terminate Service
We reserve the right to refuse or terminate service if:
- Unsafe or hazardous conditions exist
- Harassment or inappropriate behavior occurs
- Payment terms are not honored

Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, including applicable consumer protection statutes such as M.G.L. c. 93A.
